Deferred Action for Childhood Arrivals – Use Caution Before Applying

Now that the United States Citizenship and Immigration Service is accepting applications under the Deferred Action for Childhood Arrivals program, there are some important things to remember:

It is important to speak to a qualified immigration attorney about your case and whether you qualify.  You should speak to an attorney regardless of whether you plan to file on your own or through attorney representation;

Do not submit your application until you have met all the requirements and have the documentation to prove each of the eligibility requirements;

Beware of Paralegals, Notarios, and certain Non-Profits who proclaim to be able to assist you with your paperwork.  As in the past, Paralegals, Notarios, and some Non-Profits have returned in an attempt to make money off of minority groups and individuals by tempting you into using their services because they charge a smaller fee than other places or licensed attorneys.    

Paralegals:  Paralegals are not allowed to give legal advice nor prepare paperwork without the direction and supervision of a licensed attorney.  It is against the law for a Paralegal to charge you for this type of service.    

Notarios:  Notarios are not licensed attorneys and often act as if they are or mislead you into thinking they are.  It is against the law for these individuals to give you legal advice or to charge you to prepare the paperwork for you.  Ask to see their license to practice law.  Ask them what their bar number is.  Ask them if they have malpractice insurance.  If they can’t answer or show you the requested documents to any of these questions then instead seek out a qualified immigration attorney. 

Non-Profits:  There are many good non-profits out there.  But there are also many non-profits who will use this new program as an opportunity to make money by taking advantage of the individuals who want to participate in this new program.  If you are going to use a non-profit, be careful in choosing it.  Make sure that they have licensed qualified immigration attorneys on staff in order to advise you of your rights and qualifications.  Do not simply let them fill out your paperwork and pay their fee without having spoken to a qualified immigration attorney to ensure that you qualify for the program.  Finding out your rights and whether you truly qualify beforehand can save you time, money, stress and energy later should you not have qualified and you are placed in deportation proceedings.
